Declarants, who can be the cargo owner, purchaser, or a licensed customs broker, are responsible for handling customs formalities. For goods consigned to a "named person," the holder of the shipper-endorsed bill of lading (or air waybill) has the right to handle clearance procedures. Additionally, importers must exercise reasonable care to provide accurate and timely data to CBP, as required by the Customs Modernization Act.
Required Documentation for Customs Clearance
Complete and accurate documentation is the foundation of smooth U.S. customs clearance, and missing or incorrect documents are a common cause of delays or detentions. Essential documents include commercial invoices (or pro forma invoices if no commercial invoice is available), packing lists, bills of lading/air waybills, and accurate Harmonized Tariff Schedule (HTS) codes. For specific goods, additional documents are required: sensitive products such as electronics and food need certificates of origin or quality certifications (e.g., FDA, FCC), while restricted items require relevant import licenses. Since September 27, 2025, CBP has implemented automated rejection of manifest filings with insufficient cargo descriptions, shipper information, or consignee information, emphasizing the importance of complete document information.
Customs Clearance Procedures and Timelines
U.S. customs clearance typically consists of four core steps: submission of paperwork for inspection, payment of import duties and taxes, CBP cargo inspection, and final cargo release. It can be divided into two phases: in the first phase, within 15 days of the cargo’s arrival at the U.S. port, declarants submit required documents (such as entry manifests and duty guarantees) for CBP review and conditional release; in the second phase, within 10 working days after conditional release, they submit additional documents (such as CBP Form 7501) and pay estimated duties. Timelines vary by transportation mode: ocean shipments can start clearance up to 5 days before the vessel’s arrival, while air shipments have a faster clearance process due to shorter transit times. Pre-arrival clearance is also available, allowing declarants to address potential issues in advance and accelerate cargo release.
